Terms and Conditions

These are the ground rules for using The Bright Garden. They cover what you can do with our content, how our affiliate and advertising links work, and the limits of the gardening advice we publish. Plain language wherever we can manage it.

1. Agreement to these terms

The Bright Garden (the “Site”) is operated by The Bright Garden, LLC (“we,” “us,” or “our”). By visiting the Site, reading our articles, using our tools, or subscribing to our emails, you agree to these Terms and Conditions and to our Privacy Policy.

If you do not agree with any part of these terms, please stop using the Site.

2. Who may use the site

The Site is intended for a general audience aged 13 and over. It is not directed to children under 13, and we do not knowingly collect personal information from them. If you are under 18, please use the Site with the involvement of a parent or guardian — particularly where gardening tools, chemicals, or edible plants are discussed.

You are responsible for making sure your use of the Site complies with the laws that apply where you live.

3. Content and license to use it

Unless stated otherwise, all articles, photographs, illustrations, guides, calculators, quizzes, code, and design elements on the Site are owned by The Bright Garden, LLC or used with permission, and are protected by copyright and other intellectual property laws.

You may read, print, and save a personal copy of our content for your own non-commercial gardening use. You may also quote a short excerpt (roughly a paragraph or less) if you credit The Bright Garden and link back to the original page.

Without our written permission, you may not:

  • Republish, syndicate, or redistribute our articles in whole or in substantial part.
  • Use our content for commercial purposes, including in paid products, courses, or client work.
  • Copy our images, tool designs, or code into another website or application.
  • Feed our content into a dataset for training machine learning or AI models.
  • Remove or alter any copyright, byline, or attribution notice.
  • Mirror, scrape, or automatically harvest the Site.

This permission ends automatically if you breach these terms, and we may revoke it at any time. If it ends, delete any copies you still hold.

4. Comments and submissions

If you leave a comment, send us a photo of your garden, or submit any other material, you keep ownership of it. You grant us a non-exclusive, worldwide, royalty-free license to publish, display, adapt, and archive that material on the Site and in our related channels, including email and social media.

You confirm that anything you submit is your own work, or that you have the right to share it, and that it does not infringe anyone else’s rights. We may edit, decline, or remove submissions at our discretion, and we are not obliged to publish anything.

5. Acceptable use

When using the Site, please do not:

  • Post unlawful, harassing, hateful, defamatory, or deliberately misleading content.
  • Post spam, advertising, or links intended to manipulate search rankings.
  • Impersonate another person or misrepresent your affiliation with anyone.
  • Attempt to gain unauthorized access to the Site, its servers, or any connected system.
  • Introduce malware, run automated attacks, or otherwise interfere with the Site’s operation.
  • Collect other users’ personal information without their consent.

6. Interactive tools and calculators

Our watering calculator, plant problem identifier, pond planner, garden style quiz, and similar tools produce general estimates based on the information you enter and on typical growing conditions. They are educational aids, not precise measurements or professional recommendations.

Real gardens vary enormously with soil type, microclimate, drainage, container size, weather, and plant health. Always confirm results against your own observation, local extension office guidance, and the instructions supplied with any product you use.

We provide these tools “as is,” may change or retire them at any time, and cannot guarantee they will always be available or error-free.

7. Gardening advice disclaimer

The Bright Garden publishes general gardening information for educational purposes. It is not professional horticultural, agricultural, veterinary, medical, or legal advice, and it is not a substitute for guidance from a qualified professional in your area.

Please take particular care with the following, and take responsibility for verifying anything before you act on it:

  • Edible and foraged plants. Never eat a plant, mushroom, seed, or berry based on an online description or photograph alone. Misidentification can be dangerous or fatal. Confirm identification with a qualified local expert.
  • Toxic plants. Many common ornamentals are harmful to children, pets, and livestock. Check with your physician, pediatrician, or veterinarian before planting.
  • Allergies and sensitivities. Plants, pollen, sap, soil amendments, and compost can trigger allergic or skin reactions.
  • Fertilizers, pesticides, and other products. Always follow the manufacturer’s label, which is the legally binding instruction, and comply with local restrictions. Where the label and our article differ, follow the label.
  • Tools, machinery, and structures. Use appropriate protective equipment. For electrical work, water features, retaining walls, tree removal, or anything structural, hire a licensed professional.
  • Local rules. Check local ordinances, HOA rules, water restrictions, and invasive-species regulations before planting or building.

Gardening results depend on conditions we cannot see or control. We make no promise about the outcome of any technique described on the Site.

8. Affiliate disclosure

Some links on the Site are affiliate links. If you click one and buy something, The Bright Garden, LLC may earn a commission at no additional cost to you. We participate in the Amazon Services LLC Associates Program, an affiliate advertising program designed to provide a means for sites to earn advertising fees by advertising and linking to Amazon.com, and in other affiliate programs.

Commissions help pay for hosting, photography, seeds, soil, and the time it takes to test things properly. They do not change what we recommend. We suggest products based on our own research, use, and editorial judgment, and we say so plainly when we have not tested something ourselves.

9. Advertising on this site

We display advertising from third-party ad networks, including Google AdSense. Those networks and their partners may use cookies and similar technologies to serve and measure ads, including ads based on your previous visits to this and other websites.

Advertisements are placed automatically by the ad network and are labeled or visually separated from our editorial content. Their appearance on the Site is not an endorsement, and we do not control what any given advertiser claims. Any dealings you have with an advertiser are between you and them.

Consent for advertising cookies is collected through a Google-certified consent management platform, and you can change your choices at any time. 11. Disclaimer of warranties

The Site and everything on it are provided “as is” and “as available.” To the fullest extent permitted by law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, non-infringement, and accuracy.

We do not warrant that the Site will be uninterrupted, secure, or free of errors, or that any content, plant recommendation, or tool result will be correct or suitable for your circumstances. Content may become outdated, and we are not obliged to update it.

12. Limitation of liability

To the fullest extent permitted by law, The Bright Garden, LLC and its owners, contributors, and affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, profits, plants, crops, property, or business, arising from your use of or inability to use the Site.

Where liability cannot be excluded, our total liability to you for any claim relating to the Site is limited to one hundred U.S. dollars (US$100). Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you.

13. Indemnification

You agree to defend, indemnify, and hold harmless The Bright Garden, LLC, its owners, contributors, and affiliates from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys’ fees) arising from your use of the Site, your submissions, or your breach of these terms.

14. Copyright complaints

We respect intellectual property rights. If you believe material on the Site infringes your copyright, email hello@thebrightgarden.com with the subject line “Copyright Notice” and include:

  • Your contact details.
  • A description of the work you say has been infringed.
  • The URL of the page on our Site where it appears.
  • A statement that you have a good-faith belief the use is not authorized.
  • A statement, under penalty of perjury, that your notice is accurate and that you are the rights holder or authorized to act for them.
  • Your physical or electronic signature.

We will review and, where appropriate, remove or disable access to the material.

15. Suspending access

We may suspend or block access to the Site, or remove content you have submitted, at our discretion and without notice, if we believe these terms have been breached or that continued access could harm the Site, our readers, or our business.

16. Changes to these terms

We may update these terms as the Site changes or as the law requires. The “Last updated” date at the top of this page shows when the current version took effect. Continuing to use the Site after a change means you accept the revised terms, so it is worth checking back occasionally.

17. Governing law

These terms are governed by the laws of the State of California, without regard to its conflict-of-law rules. You agree that any dispute relating to the Site will be brought in the state or federal courts located in California, and you consent to their jurisdiction.

If any provision of these terms is found unenforceable, the rest remains in force.
